============================================== 01 Verfassungsbruch From: office (at) asyl-in-not.org ============================================== Verfassungsbruch Wir leisten Widerstand Frau Prokop hat einen Asylgesetzentwurf vorgelegt, der Herrn Strassers Gesetz an Verfassungswidrigkeit noch übertrumpft. Wie erinnerlich, hatte der Verfassungsgerichtshof im Oktober letzten Jahres entschieden, daß Berufungen gegen Ausweisungsbescheide im Zulassungsverfahren die aufschiebende Wirkung zukommt. Das bedeutet, daß Flüchtlinge, deren Anträge wegen angeblicher Zuständigkeit eines anderen "Dublin"-Staates zurückgewiesen wurden, nicht zurückgeschoben werden dürfen, solange das Berufungsverfahren läuft. Der neue Entwurf setzt sich dreist über diese Entscheidung des Verfassungsgerichtshofes hinweg. Jetzt heißt es nämlich: "Einer Berufung gegen eine Ausweisung (im Dublin-Verfahren) kommt eine aufschiebende Wirkung nur zu, wenn sie vom Bundesasylamt zuerkannt wird." Und wenn das Bundesasylamt das nicht tut? Ja richtig, dann kann man einen Antrag stellen. Über den irgendwann einmal entschieden werden wird. Natürlich negativ. Dann kann man Berufung erheben an den UBAS. Der hoffentlich entscheiden wird, solange man noch nicht abgeschoben ist... Bis dahin, so lässt Frau Prokop verlauten, sitzen die Flüchtlinge nämlich hinter Gittern. In Dublin-Verfahren, so stand es gestern in den Zeitungen, soll generell die Schubhaft verhängt werden, damit die Flüchtlinge nicht untertauchen. Eingesperrt werden soll aber auch, wer einen "Folgeantrag" stellt - einen neuen Asylantrag, weil etwas Neues geschehen ist. Auch diese Schubhaftbestimmung hatte der Verfassungsgerichtshof aufgehoben; Frau Prokop führt sie durch die Hintertüre wieder ein. Und natürlich: Die Ausnahmeregel, daß Folteropfer und Traumatisierte nicht abgeschoben werden dürfen, sondern zum Verfahren zuzulassen sind, steht nicht mehr im neuen Entwurf. Auch diese am schwersten Verfolgten will man nun ohne Gnade deportieren - in Dritt- und "Dublin"-Länder, von denen wir wissen, daß sie dort nicht sicher sind. Wie erinnerlich, sind voriges Jahr tatsächlich viele, vor allem tschetschenische Asylwerber aus der Erstabschiebestelle Traiskirchen geflüchtet, weil sie sonst in die Slowakei deportiert worden wären, die sie weitergeschoben hätte in Putins Folterkammern; die enge Verbindung des slowakischen mit dem russischen Geheimdienst ist uns bekannt. Wie erinnerlich, haben SOS Mitmensch und Asyl in Not dazu aufgerufen, Verfolgte privat unter Schutz zu stellen; Herr Strasser ließ daraufhin ein Strafverfahren gegen SOS-Mitmensch-Obfrau Nadja Lorenz konstruieren. Privater Schutz wird auch jetzt wieder nötig sein, in noch weit größerem Maß. Daher hat Frau Prokops Schwester im Geist, FP-Miklautsch, eine "Lex-NGO" angekündigt: "Hilfe beim Untertauchen von Asylwerbern" soll unter Strafe gestellt werden, "zur Abschreckung". Davor fürchten wir uns aber nicht. Wir vertrauen auf die moralische und politische Kraft des Widerstands. Frau Miklautsch wird ihre Amtsdiener warm anziehen müssen, bevor sie sie auf Menschenjagd schickt. Wir werden sie nämlich ein bisschen spazieren führen im anderen, im demokratischen Österreich. Frau Prokop hat noch nicht verstanden, daß sie andere Partner braucht als die Haiderpartei, wenn sie Zukunft haben will. Weil die Zeit von Schwarz-Blau bald ablaufen wird. Will sie wirklich in letzter Minute Fundamente des Rechtsstaates zerschlagen? Herr Strasser musste gehen, nicht zuletzt, weil er anderen politischen Optionen im Wege stand... Neue, schwere Auseinandersetzungen kommen auf uns zu. Wir sind vorbereitet darauf. Am Ende wird das Menschenrecht siegen. Die Seite beinhaltet eine breite Palette an Bildungsangebot für junge Leute zum Thema Tourismus. März, 19.00 Lügen in der Wirtschaftspolitik Buchpräsentation Obwohl es alle angeht, überlassen in Sachen Wirtschaftspolitik viele Menschen das Feld lieber den Fachleuten. Anscheinend benötigen die Teilnahme an der öffentlichen Diskussion und mehr noch das wirtschaftspolitische Handeln zu viel grundlegendes Fachwissen. Wenn es in der Wirtschaft vorrangig um Macht, Ideologien und Interessen geht, dann ist für die demokratische Kontrolle jeder Wirtschaftspolitik die Unterscheidung von Fakten, Thesen und Mythen eminent wichtig. März, 19.00 Im Namen Gottes Diplomarbeit Machtpolitik wurde in der Geschichte immer wieder religiös begründet. Kaum eine historische Figur hat das so konsequent praktiziert wie Oliver Cromwell. Im Namen Gottes wollte er "England groß und seine Feinde zittern machen". Den religiösen Hintergrund dafür fand er im protestantisch-manichäistischen Weltbild. Weil heute wieder Kriege mit religiösen Vorzeichen geführt werden, lohnt es sich, auf Cromwells Begründungen für seine Kriege einzugehen. März, 20 Uhr Vortrag und Diskussion mit Thomas Becker (Bielefeld) "Der Iran und die Bombe" Seit zwei Jahren ist der IAEA das bis dahin erfolgreich geheim gehaltene Atomwaffenprogramm des Iran bekannt. Die Berichte ihrer Inspektoren, die seit dem Frühjahr 2003 im Iran Ortsbesichtigungen durchführen, dokumentieren jedes technische Detail und die Funktion jeder einzelnen Anlage des Atomwaffenprogramms und liefern ein lückenloses Beweismaterial: Die Arbeiten an den Anlagen zur Anreicherung von Uran und Plutonium sind inzwischen so weit fortgeschritten, dass der Iran in zwei oder drei Jahren über die ersten Atomwaffen verfügen wird, sofern ihn niemand daran hindert. Während Israel und auch die USA bereits mehrfach klarstellten, dass sie nicht gewillt seien, den Aufstieg Irans zur Atommacht hinzunehmen, schlug die EU einen gänzlich anderen Weg ein: Angeführt von Deutschland und Frankreich versucht sich die EU in einem mal "kritischen" mal "kulturellen Dialog" mit den Mullahs, einem Regime, welches immer wieder betont, dass es gewillt ist, Israel auszulöschen. Unter allen Umständen soll eine militärische Intervention verhindert werden. Die EU schlägt zwei Fliegen mit einer Klappe: einerseits präsentiert sie sich gegenüber dem Iran als verlässlicher Partner, indem sie sich deutlich von den USA abgrenzt, andererseits erscheint sie auch anderen auf blutiger Unterdrückung beruhenden Regimes als pazifistischer und damit für die Kontinuität der Herrschaftsführung garantiert ungefährlicher Staat. März, 19.30 Uhr "El Salvador im Film zwischen Revolutionsromantik, Dokumentation und Hollywood" Anläßlich des 25. Todestages von Erzbischof Romero. Am 24. März 1980 wurde Monseñor Romero am Altar ermordet. Die Namen des Mörders und seiner Auftraggeber sind bekannt. Eine gerichtliche Aufarbeitung in El Salvador steht allerdings noch immer aus. Er prangerte die Todesschwadronen an, verurteilte Sonntag für Sonntag in seinen Predigten Menschenrechtsverletzungen und Repression, stellte sich kompromisslos auf die Seite der Armen und forderte schließlich am Tag vor seiner Ermordung die Soldaten der Armee auf, nicht auf die Brüder aus dem eigenen Volk zu schießen. Auch 25 Jahre nach seiner Ermordung ist Romero noch immer ein Symbol für Gerechtigkeit und Solidarität. Das El Salvador Komitee Wien lädt zu einer Filmvorführung ein: "Salvador im Film zwischen Revolutionsromantik, Dokumentation und Hollywood", mit Leo Gabriel. Gezeigt werden: Dokumentarfilm-Material aus den 80er Jahren und der Film "Salvador" von Oliver Stone. ----------------------------- Freitag, 11. März, 20.15 Uhr Kabarett mit Martin Wagner "Ernstln" oder "Die Himmelfahrt eines unbelohnten Helden" Von pränatalen Besitzansprüchen während der späten 50iger Jahre und dem sich ankündigenden Wirtschaftswunder, über die Kehrseite einer zu späten Geburt bis zu einem traumhaften Abgang samt jenseitigen Analysen des Dieseitigen. In seinen beiläufigen bis kasperlesken Reminiszenzen gelingt es dem Mitlifigen Jungkabarettisten Martin Wagner mühelos, Lachmuskelstränge und Hirnwindungen so wirr zu verknüpfen, dass man diese - zumindest während seiner Vorstellung - kaum mehr von einander trennen kann. Locker, frech, treffend und immer um die Spur direkter, als man rechnet, ist "Ernstln" - sein erstes eigenes Programm - eine Einserbank auf einen unterhaltsamen Abend auf die man (sich) unbedingt setzen sollte. März, 19.30 Uhr Konzert "ÄGÄISCHER ZEYBEK-LIEDER ABEND" Wie jedes Gebiet in der Türkei, hat auch die westanatolische Region (Ägäisregion) ihre eigenen Lieder, die Zeybek genannt werden. Wir wollen ihnen mit diesem Konzert einen kleinen Einblick in die Klangwelt der Zeybek Lieder ermöglichen. Die für die Region typischen Zeybek-Lieder werden im Kreis Izmir gesungen. Zeybek stammt aus dem östlichen Mittelmeerraum wo er seit dem 17. Jahrhundert bekannt ist. Einige dieser Lieder sind Kerimoglu, Cökertme, Keklik, Elif, Ormanci, Izmir'in Kavaklari und Deniz Üstü Köpürür. März, 19 Uhr Vortrag und Dikussion mit Tjark Kunstreich (Berlin) "Unterwerfung und Widerstand" Ayaan Hirsi Ali nahm am 18. Januar 2005 - nachdem sie, aufgrund der Ermordung Theo van Goghs, untertauchen musste - ihre arlamentarische Arbeit wieder auf und damit ihren Kampf für die Rechte moslemischer Frauen auf Bildung und eigenes Einkommen, weswegen sie auch weiterhin unter permanenter Todesdrohung steht. Ihr trotzdem unverminderter Widerstand gegen den von kulturrelativistischer Öffentlichkeit und islamistischen Gruppierungen gleichermaßen ausgeübten Zwang, ein moslemisches Kollektiv gefälligst konstruktiv zu kritisieren und ihren Platz als Quotenmigrantin einzunehmen, die von der Mehrheit Akzeptanz kultureller Eigenheiten fordert, ist vielleicht ein letztes Aufbäumen bürgerlicher Subjektivität, eine andere gibt es nicht, gegen die gesellschaftliche Regression. Dieser Widerstand ist Kampf gegen den größten Sieg der Islamisten in Europa, der darin besteht, dass der Islam nur noch als Kultur und "die" Moslems nur noch als Kollektiv wahrgenommen werden und Plädoyer für individuelle Emanzipationsbestrebungen. Damit ist er zugleich und in einem die Verteidigung der Bedingungen und Möglichkeiten zur Subjektwerdung gegen die Zumutungen des Ethnisierungszwangs sowie die Abwehr der mit diesem einhergehenden Vernichtungsdrohung. GMO = gen-manipulierte Organismen (Teil 1 + Teil 2) Regie: Suzanne Körösi - Frankreich 2003 Eine Dokumentationsreihe über die wissenschaftlichen, politischen, wirtschaftlichen und sozialen Probleme, die durch genveränderte Organismen (GMO) hervorgerufen werden. In den letzten Jahren war die finanzielle Situation von Biotech-Unternehmen durch die Ablehnung der KonsumentInnen rückläufig. Der Film beginnt mit einer turbulenten Pressekonferenz von französischen Forschern und Lobbyisten, die die GMO-Produktion verteidigen. Dem Anbau- und Ernte-Zyklus in verschiedenen Regionen Frankreichs folgend, erklären ein kanadischer und mehrere französische Bauern und Bäuerinnen die zerstörerischen Effekte von GMO-Verseuchung und die Verantwortung der LandwirtInnen, die Bevölkerung mit risikoarmer Nahrung zu versorgen. Februar im Rahmen einer internationalen Delegation nach Istanbul gereist. Das Thema, das mich insbesondere beschäftigte ist ein Massenprozess, der am 1. April 2004 mit einer Operation gegen sämtliche demokratische, legale Vereine und deren Mitglieder begann. Diese Operation ist von Italien ausgegangen, hatte jedoch vor allem repressive Massnahmen und Rechtsverletzungen gegen demokratische AktivistInnen in der Türkei zur Folge. Mehr als 100 Menschen wurden anhand von gefälschten Dokumenten und Disketten festgenommen. 82 davon verhaftet. Obwohl das Gericht entschied, dass die Disketten nicht als Beweismittel eingesetzt werden können, befinden sich immer noch dutzende Menschen in Haft und die Repressionswelle dauert an. Da ich mich seit vielen Jahren für die Menschenrechte - unter anderem in der Türkei - einsetzte, sind mir die Methoden, die gegen die demokratische Opposition in diesem Land angewandt werden, bestens bekannt. Ich habe mich oftmals an Beobachtungsdelegationen beteiligt und mit eigenen Augen gesehen, wie die Menschenrechte hier mit Füßen getreten werden. Folter steht immer noch an der Tagesordnung. Das wird durch sämtliche Menschenrechtsorganisationen und NGO's fast täglich bestätigt. Eines der besten Beispiele für die "Scheindemokratie" sind die Gefängnisse, die nach wie vor eine offene Wunde sind. Menschen werden verhaftet und sind selbst dort ihres Lebens nicht sicher. Im Jahr 2000 wurde ein massives Isolationsregime eingeführt, welches die Repression gegen Gefangene weiter verschärfen sollte. Gegen die Politik, die für die gesamte demokratische Opposition eine Bedrohung darstellt, gibt es seit 4 Jahren einen ausgedehnten Widerstand, bei dem bereits 118 Menschen ihr Leben verloren haben. Dennoch wird mit erbitterter Zensur versucht, diese Tatsachen zu verheimlichen. Ich betrachte es als eine Aufgabe, diese Umstände ans Tageslicht zu bringen und einen geringen Beitrag für demokratische Veränderungen zu leisten. Nun bin ich selbst zur Zielscheibe geworden. Aber das wird meine Einstellung zu alldem nicht ändern. Ich bin als Mitglied der illegalen Organisation DHKP/C angeklagt, weil ich mich mit demokratischen Mitteln gegen dieses Unrechtssystem stelle. In a fax sent to all Italian public prosecutors they say that they have already over-stretched their capacity from 5.000 to 7.000 simultaneously intercepted mobile phones. New requests now have to be processed on a 'first come first serve' basis, they write. Even more unique in the current secretive environment of law enforcement, the Italian Minister of Justice Roberto Castelli (right-wing Lega Nord) has provided the newspaper Repubblica with statistics about the number of wiretaps and costs. The number of wiretaps has doubled every two years, he said, from 32.000 intercepts in 2001, to 45.000 in 2002, to 77.000 in 2003. He estimates the number of wiretaps in 2004 to be 100.000, costing the Justice department aprox 300.00 million euro in cost reimbursements. In 2003 the department of Justice spent 225 million euro on the intercepts, in 2002 230 million and in 2001 165 million. Castelli admitted the number of police intercepts in Italy was very high. Currently Italy has aprox 58 million inhabitants. With 100.000 intercepts in 2004, Italy orders 172 judicial intercepts per 100.000 inhabitants. There is no information about wiretaps ordered by secret services in any country. Castelli referred to the report of the German Max Planck Institute which already concluded Italy was the wiretapping champion of the (western) world with 76 intercepts per 100.000 inhabitants (44.000 wiretaps in 1996). The number two on the European wiretapping list in 1996, the Netherlands, refuses to provide any recent statistics. According to unofficial estimates the Netherlands intercepted 12.000 phones (fixed and mobile) in 2004. If those numbers are correct, the Netherlands have 75 intercepts per 100.000 inhabitants. In the United States, the most recent public statistics date from 2002. They mention 1.273 court ordered intercepts on a population of aprox 293 million, totalling 0,43 intercepts per 100.000 inhabitants. The UK Communication Commissioner mentions a total of 1.983 warrants for intercepts in 2003 on a population of 59,5 million, totalling 3,3 intercepts per 100.000 inhabitants. One possible explanation for the explosion of the number of wiretaps in Italy is their short duration. An order is valid for 15 days and can only be extended with a new motivation from a magistrate. Only for investigations into organised crime an intercept can last 40 days. In many other countries, intercepts have a duration of 1 to 3 months. Vodafone and Wind, two other major mobile phone companies, are also reaching their maximum wiretapping capacity, reports Repubblica. While Castelli used the occasion to warn against overuse of wiretapping in investigations, the Italian magistracy doesn't seem to agree. Edmondo Bruto Liberati, President the National Association of Magistrates (association of both judges and public prosecutors) stressed that wiretapping is much cheaper than individual covert surveillance. He complained about the vast under-financing the judicial apparatus is currently suffering from. This public debate between the Minister and the magistracy points at a more fundamental division in Italian politics. By stressing the immense costs of wiretapping the Minister of Justice adds weight to his attempt to shift the costs to the Ministry of Internal Affairs. Generally the Minister pictures an image of a foolish magistracy that abundantly spends public money. This comes as no surprise to many Italians, given the tense relationship between Berlusconi and the magistracy. MP Giovanni Russo Spena (left wing opposition, Rifondazione Comunista) has demanded an explanation from the government about the massive use of wiretapping in investigations and wishes to be informed how citizens are protected against this potential and actual invasion of their privacy rights. Februar 2005, www.arbeiterInnenstandpunkt.net) Am Mittwoch, 16.02.2005, wurde der Ex-FP-Landeschef Ernest Windholz zu einer Strafe von 40 Tagessätzen á Euro 28,- (oder 20 Tage Ersatzfreiheitsstrafe) wegen leichter Körperverletzung verurteilt. Seinem Einspruch wurde nicht statt gegeben, aber seine Strafe von 70 (oder 35 Tage Ersatzfreiheitsstrafe) auf 40 Tagessätze gesenkt. Zur Vorgeschichte: Am 11.06.2004 veranstaltete die FPÖ ihre Abschlussveranstaltung zu den EU-Wahlen am Wiener Viktor-Adler-Markt im 10. Bezirk. RednerInnen waren u.a. der Wiener FP-Rechtsaußen Heinz-Christian Strache oder der Kärntner Landeshauptmann Jörg Haider. Mehrere linke Organisationen, darunter der ArbeiterInnenstandpunkt und REVOLUTION, veranstalteten eine Gegendemonstration. Nach dieser fuhr das ehemalige Mitglied der AL-Antifaschistische Linke, Dieter Reinisch, mit dem Zug in seine niederösterreichische Heimatgemeinde Bad Deutsch- Altenburg. Dort wollte er eine FP-Ankündigung für ein Sommernachtsfest in B.D.- Altenburg beschmieren. Ehrengäste waren u.a. rechtsextreme FPler wie der Großkapitalist Thomas Prinzhorn oder Volksanwalt Ewald Stadler, für den Österreich ja erst 1955 befreit wurde. Dabei beobachtete ihn der ebenfalls in B. D.- Altenburg wohnhafte Ex-FP-Landeschef Ernest Windholz, rief ihm zu: "Jetzt hab ich dich, du Drecksau!", und verfolgte ihm mit seinem Auto gegen die Einbahn. Als er ihn eingeholt hatte, stieg er aus dem Auto aus, lief zu Reinisch und versetzte ihm zwei Faustschläge ins Gesicht und eine Tritt auf den Fuß. Danach verfolgte er den linken Aktivisten und drohte ihm: "Wirst schon sehen, was jetzt mit dir passieren wird." Reinisch fuhr ins a.ö. Krankenhaus Hainburg an der Donau wo eine Kieferprellung diagnostiziert wurde und erstattete Anzeige wegen Körperverletzung am Gendarmerieposten Regelsbrunn. Im Falter Ausgabe 25/04 meinte Windholz, er hätte den Antifaschisten nur ins Gewissen reden wollen. Am Montag, 4.10.2004, wurde er schließlich vom Bezirksgericht Bruck an der Leitha wegen Körperverletzung (§ 83 Abs 1 StGB) zu einer Strafe von Euro 1960,- verurteilt. Bei der Gerichtsverhandlung meinte er zuerst, es hätte nie irgendeinen Körperkontakt mit Reinisch gegeben, wenig später sagte er jedoch, dass der linke Aktivist vielleicht durch das Öffnen seiner Fahrertür die Verletzungen im Gesicht erlitt. Auf die Frage der Richterin Mag. Bettina Marosits: "Sie sagen, es kann sein, dass er durch das Türöffnen verletzt wurde, was stimmt jetzt ?", antwortete der Angeklagte: "Es stimmt wohl beides." Der FPler legte Berufung wegen "Nichtigkeit, Schuld und Strafe" ein und verweigerte von nun an den Medien jede Aussage. Er wolle nämlich niemanden schaden, Dieter Reinisch komme ja aus gutem Haus und sei einfach nur ein "irregeleiteter Jugendlicher" (Windholz im NÖN-Interview, Juli 2004). Am Mittwoch, 16.02.2005, wurde der Berufung am Landesgericht Korneuburg nicht statt gegeben, seine Strafe aber von 70 auf 40 Tagessätze á Euro 28,- gesenkt. Der Richter Dr. Alexander Fiala begründete seine Entscheidung, dass es "in einem Rechtsstaat keine Selbstjustiz gibt", doch wurde die Strafe gesenkt, da eine "vorangegangene Beschädigung des Privateigentums von Windholz" den Angeklagten provozierte. Vielleicht sollte dies den ArbeiterInnen von Werbefirmen besser gesagt werden, damit sie bei der nächsten Plakatwelle im Stile von "Einer, wie keiner" oder "Einer, der uns versteht" besser auf das Privateigentum der jeweiligen SpitzenkandidatInnen aufpassen . Der Antifaschist Dieter Reinisch war dennoch über den Ausgang des Verfahrens erfreut, doch betonte er, kein Vertrauen in die Justiz zu setzen. Der Kampf muss von den ArbeiterInnen und Jugendlichen geführt werden, denn "Windholz ist nur ein kleines Rad im FPÖ-Apparat. Die wahren VerbrecherInnen sitzen noch immer in der Regierung und im EU-Parlament und schieben täglich politisch Verfolgte in ihren Tod ab, sie unterdrücken die Bevölkerung im Trikont und verhaften linke AktivistInnen wie Sandra Bakutz". Windholz ließ den niederösterreichischen Nachrichten mitteilen, dass es sich um einen "Justizirrtum" handle und er nun den Gang zum europäischen Gerichtshof für Menschenrechte anstrebt. Der FP-Politiker Windholz gilt als einer der führenden VertreterInnen des rechtsextrem-rassistischen Flügels der Partei, neben Mölzer, Strache oder Stadler und war einer der führenden Parteimitglieder am Parteitag in Knittelfeld, der schließlich die erste BürgerInnenblock-Regierung Österreichs zu Fall brachte. Er war bereits öfters in den Medien. Etwa als er bei einem FPÖ-Parteitag im Jahr 2000 den SS-Fahnenspruch: "Unsere Ehre heißt Treue!", ins Publikum rief. Doch jux, als er im APA-Interview zur Rede gestellt wurde, wollte ihm doch plötzlich nicht mehr einfallen, was denn dieser Spruch zu bedeuten hätte. Am 6.März sind Gemeinderatswahlen in B. D.-Altenburg. Die FP tritt diesmal unter anderem Namen und mit der Farbe Orange an, denn das neu gegründete "Team Ernest Windholz. Parteiunabhängige und Freiheitliche" will nicht mehr für die "Fehler der Bundespartei gerade stehen". Auch brüstet man sich, dass von der 20 Personenliste 13 kein Parteibuch haben. In Wahrheit gingen der FP-Bad Deutsch-Altenburg nach internen Streitereien in den letzten Monaten und Jahren die Leute aus, mangels Geldnöten wird auf einen größeren Wahlkampf verzichtet. Doch nicht nur deshalb wird das absolute Spitzenergebnis bei den Wahlen im Jahr 2000 nicht mehr zu halten sein. Damals bekam die FP rund 38,3 Prozentpunkte bzw. 7 von 19 Gemeinderäten. Die SPÖ erhielt knapp 42,1% bzw. 9 Mandate und die ÖVP bekam weniger als 19,6% bzw. 4 Mandate im Gemeinderat. Bei den Nationalratswahlen 1999 waren es sogar noch mehr und bei den EU-Wahlen, als die FPÖ bundesweit auf etwa 6% durchgereicht wurde, verzeichnete sie in der 1800 Seelen Gemeinde B. D.-Altenburg immer noch eines ihrer besten Ergebnisse und bekam über 20%. Die jüngere Vergangenheit zeigt, dass obwohl die FPÖ vermutlich im Vergleich zu den letzten Wahlen an Stimmen verlieren wird, sich gleichzeitig die Rechten in und um der FPÖ stärker positionieren werden. "Wir bedauern zugleich die unmenschliche Haltung von Bundesinnenminister Otto Schily, der Ministerpräsident Christian Wulff am 17. Februar in einem Schreiben mitgeteilt hatte, dass das Urteil des Verwaltungsgerichtes Braunschweig nicht zu beanstanden sei", sagte der GfbV-Generalsekretär Tilman Zülch am Mittwoch in Hannover. Das Verwaltungsgericht hatte eine Verfolgungsgefahr wegen der Konversion der 24-Jährigen zum Christentum und wegen Ehebruchs nicht anerkannt. Demgegenüber gehen alle Iranexperten und Menschenrechtler von einer Gefahr für Leib und Leben der jungen Frau aus. Der Innenminister Niedersachsens, Uwe Schünemann, hat nach Auffassung der GfbV durch das gefühllose und menschenunwürdige Tauziehen um das Schicksal der von Abschiebung bedrohten iranischen Christin Zahra Kameli viele Sympathien in der Bevölkerung verspielt. "Das Innenministerium hat sich unerbittlich auf Paragraphen berufen und gleichzeitig den Eindruck zu erwecken versucht, die Zukunft Niedersachsens hinge von der Ausreise einer einzigen verfolgten und unschuldigen Person ab", kritisierte Zülch. "Der Fall hat hohe Kosten verursacht, ganz zu schweigen von den seelischen Qualen, die die junge Frau selbst durchleiden musste. 'Banned publication' punishment to distributing company - 19.02.2005 D†YARBAK†R (D†HA) - The Diyarbakir 1st Court of General Criminal Jurisdiction sentenced Ramazan PekgOz, Firat Distributing Company's Diyarbakir Manager to a fine of YTL 779.381 (TL 779.831.000) for maintenance of banned daily, magazine and book. On May.12th 2004, the police of Diyarbakir Security Directorate raided the Diyarbakir Bureau of Firat Distributing Company and taken Manager PekgOz. After interrogation in the security directory, PekgOz was sent to the court with allegation he had ''helped and provided accommodation for an outlawed organization'', but was released with condition to be tried. †n the case opened for "maintenance of banned publication" at Diyarbakir 1st Court of General Criminal Jurisdiction, amercement emerged for PekgOz. He was punished with 3 months' light imprisonment and an amend of TL 111.401.000 (YTL) 111.401 for having banned publications the †stanbul State Security Court judged to be banned and collected. There is no offense components in any of sentences claimed to bear crime elements. The investigation shows how the administrators think of the book. Those who allowed Kurdish courses to be opened in order to please the EU evidence with lawsuits they bring before judges that they cannot imbibe Kurdish language. Kurdish courses are contrary to the equality principle of the Turkish Constitution. To a public, its own language cannot be taught with special courses. Concept Kurdistan is a geographical one and takes place on the whole of world maps. The case is definitely not lawful". A†'s Turkey Coordinator: We have made action call for Aygun - 18.02.2005 †STANBUL (D†HA) - Amnesty †nternational (A†) has called an urgent action for Attorney Huseyin Aygun, the former chairman of Tunceli Bar who was threatened by Field Officer of Tunceli Namik Dursun. "Threats have been keeping on, threatening handouts were left before the bureau last" said the former father of the bar. Amnesty †nternational has also offered backing to Huseyin Aygun, who claims to have been threatened by the Field Officer of Tunceli Namik Dursun after non-governmental organizations boosted him. A†'s Turkey Urgent Action Coordinator Servet Cetin, speaking to D†HA, explained that they had called an urgent action including fears of safety and said they thought the reason why Aygun has been threatened to be his work he carried in the past. The call will go on by March 29. A† believes that the reasons why Aygün has been menaced are those he carried out some works in the domain of human rights, represented the families of 7 people who disappeared in Mirik village, Tunceli in Sep. 1994 in the court and examined the case. This work attracted attention of the Turkish Grand National Assembly's Human Rights †nquiry Comission and asked Aygün for information. †t has been reported that the Gendarmerie Commander made an interview and told him:" We know you very well. Relatives of two villagers found dead applies to court - 17.02.2005 S†DD†K GULER HAKKAR† (D†HA) - The relatives of two villagers Enter Ozdemir and Bapir Cita, who were found dead in †Sikli village of Cukurca, Hakkari, in 1995 after taken by militaries for guidance, have applied to the court 11 years later. †t is asserted that the militaries raided †sikli village, Cukurca, Hakkari, in 1995 after an armed conflict happening between the Turkish Armed Forces and PKK, and took Enter Ozdemir and Bapir Cita to show the route of guerillas. Just after a day they resigned from their charges of village guard, the two were found dead in a state their hands and feet had been tied and their bodies had been broken. Enter Ozdemir's son Yusuf Ozdemir appealed to the public prosecutor's office after 11 years over the incident. ''Threatens delays application' Stating the reason why he was not able to make any judicial attempts is to be threatened, Ozdemir said: "My father was killed though he was innocent. † want the murderers to be captured and forced to stand before the judge anyhow" and started telling D†HA how he was threatened not to have a course to the prosecutor as such:" After the bodies were found, we informed the prosecutor on the murder. He asked us to bring the corpses to the city center of Cukurca due the clashes in the region, the rural area nearby †Sikli village. But the troops came to the venue and told us to burry the funerals immediately. We reported what the prosecutor had asked us to the troops, but they began harassing us and menaced us with death. Afterwards, under the control of the militaries we brought the corpses to the village, which the soldiers had evacuated, and buried them. Since we were constantly menaced, we were not able to litigate a cause, have applied to the public prosecutor's office of Yüksekova. We hope justice will return our rights" Eye witness appeals as well A villager named Omer Onal pointed out he did testify what had happed and applied to the same prosecutor's office. "The troops took the two villagers. After a few hours, † heard gun voices coming from the back of the village. We could not go there because our fear to safety of life, but after a day in the morning we did go. We found the two on the spot. The proofs on the incident place evidenced that they had been dragged on the ground with vehicles. They had been killed after dragged" said Onal.
