Austrian Apartheid:
Operation Spring-Prozess gegen Sabinus am 10.12.2002
(5. Verhandlungstag des Wiedereinsetzungsverfahrens)

Nachdem Richter R. bei der letzten Verhandlung am 3.9.02 behauptete (
http://www.no-racism.net/gemmi/prozessbericht_sabinus030902.htm ), es sei
damit zu rechnen, dass der Prozess in drei Wochen fortgesetzt werde, ist es
mehr als drei Monate später tatsächlich weitergegangen. Zeit spielt also
keine Rolle, es sei denn, du bist Gefangene/r der rassistischen
Klassenjustiz und musst Tag und Nacht die miesen Zustände im LG1 ertragen.
Aufgrund der Verschleppung des Verfahrens durch mehrere Richter muss
Sabinus, wie die anderen Gefangenen der Operation Spring auch, diese
Zustände jetzt schon seit 3 Jahren und 7 Monaten ertragen. Und sich dann
auch noch einer mitnichten gerechten Gerichtsbarkeit stellen. Kürzlich
sagte Sabinus, er wisse genau, dass sie ihn brechen wollen, aber er werde
das nicht zulassen und weiter gegen dieses rassistische System kämpfen - so
wie Nelson Mandela in den Kerkern von Apartheid-Südafrika fast 30 Jahre
lang Widerstand geleistet hat.

Déjà-vu

Zu Beginn des Prozesses wiederholt der Richter einmal mehr die hinlänglich
bekannten Anklagepunkte gegen Sabinus - angeblicher Verkauf von geringen
Mengen Drogen, ausschliesslich gestützt auf die belastenden Aussagen einer
sich ständig widersprechenden Zeugin; dazu noch der berüchtigte Vorwurf des
`Verkaufs einer nicht feststellbaren Menge an unbekannte Personen´.
Die vom Anwalt beantragte wortwörtliche Übersetzung der Abhörprotokolle in
Igbo und deutsch ist mittlerweile vorhanden, wenn auch unvollständig: Der
Anwalt weist darauf hin, dass eine Passage, die der anonymisierte
Dolmetscher in der vorletzten Hauptverhandlung (
http://www.no-racism.net/gemmi/prozessbericht_sabinus050702.htm ) übersetzt
hat, jetzt sonderbarerweise `ein paar undeutliche Wörter´ enthält. Der
Richter kontert mit der Verlesung von zusammenhanglosen Gesprächsfetzen aus
der sog. `Übersetzung´. Es geht um einen Streit, jemand beschwert sich über
Verpackungen und irgendwas wird mit einer Waage abgemessen. Ungeachtet des
Mangels an Aussagekräftigkeit einer derartigen `Übersetzung´ gibt der
Richter immerhin zu, dass `halt nicht genau übersetzt´ worden ist ­ alles
wie gehabt also.

Wie eine Unterschrift zustande kommt, oder: ausgeliefert dem Polizeiverhör

Der Richter bezieht sich jetzt auf die Niederschrift des Polizeiverhörs von
Sabinus bei der Kripo in Graz 1999. Konkret geht es um das Handy eines
Freundes, das Sabinus zeitweise benutzt hat. Die Kripo behauptet in der
Niederschrift, dass dieses Handy dem Sabinus selbst gehört habe. Der
Richter war zwar beim Verhör nicht anwesend, vermeint aber dennoch zu
wissen, dass eine beeidete Dolmetscherin die Niederschrift korrekt
übersetzt und Sabinus unterschrieben habe. Sabinus besteht darauf, dass er
nie gesagt hat, das Handy gehöre ihm ­ beim Verhör ist ihm eine solche
Frage gar nicht gestellt worden. Darauf die naheliegende Frage,
verblüffenderweise vom Richter (!) gestellt: `Das hat also die Polizei
dazugeschrieben?´ Sabinus antwortet, indem er die Situation beim Verhör
schildert: Er hat gar keine Chance gehabt, etwas zu erklären und hat sich
schliesslich geweigert, zu unterschreiben. Den Inhalt der Niederschrift hat
er nicht verstanden, da sie ausschliesslich in deutsch verfasst war. Aber
die Polizei hat ihn zur Unterschrift gezwungen. Für den Richter alles kein
Grund zur Beunruhigung, denn: `Es war ja eine beeidete Dolmetscherin da´.
Sabinus weiss davon nichts.

Objektive Stimmanalyse
Nun befragt der Anwalt den Sabinus, ob er seine Stimme erkannt habe, als in
einer der vorherigen Verhandlungen ein abgehörtes Telefongespräch
vorgespielt wurde. Nein. Und ob es richtig sei, dass die Verteidigung vor
der Antragstellung dem Sabinus genau erörtert habe, was eine Stimmanalyse
bedeutet ­ also welche Konsequenz es bedeutet, wenn sich dabei
herausstellt, dass es seine Stimme sei. Sabinus bestätigt das und sagt, er
hat einer Stimmanalyse zugestimmt, weil er beweisen wollte, dass dies nicht
seine Stimme ist. Er weiss mit Sicherheit, dass es nicht seine Stimme ist ­
andernfalls hätte er ja wohl kaum zugestimmt.

Die Logik des Despoten und der Lauschangriff

Wieder mit Bezugnahme auf das Polizeiverhör in Graz behauptet der Richter,
dass Sabinus dort ausgesagt habe, er kenne das Restaurant `Willkommen´ in
Wien nicht. Sabinus stellt richtig, dass er damals gefragt wurde, ob er ein
Lokal kenne und er hatte geantwortet, dass er viele kennt, wohin er Essen
gegangen ist, aber nicht das genannte. Er hatte die Frage so interpretiert,
dass es sich um ein Lokal in Graz handle, was ja auch naheliegend ist. Der
Richter widerspricht und versucht nun, die bei der Operation Spring
angewendeten polizeistaatlichen Bespitzelungsmethoden zu legitimieren: Die
Observationsbeamten hätten den Sabinus ­ genannt `unbekannte Person UP15´ -
beobachtet, demzufolge sei er in eineinhalb Monaten 21 mal im `Willkommen´
gewesen, manchmal sei er innerhalb von Minuten rein- und rausgegangen.
Sabinus sagt, das stimmt nicht. Der Richter rezitiert im folgenden für eine
sehr lange Zeit, teilweise in unartikulierbarem Murmeln, aus den Akten; er
nennt irgendwelche Daten und Uhrzeiten und behauptet, da sei Sabinus beim
Rein- und wieder Rausgehen beobachtet worden. Das ganze gespickt mit
zynischen Bemerkungen wie `Erinnert er sich nicht mehr, dass er sooft dort
war?´ Sabinus stellt mehrmals klar, dass er nicht öfter als einmal am Tag
in ein Lokal zum Essen gegangen ist und dass er natürlich nicht mehr weiss,
an welchem bestimmten Tag im Februar 1999 er dort gewesen ist - und genau
das hat er auch beim Verhör und bei der U-Richterin ausgesagt. Aber mit
Hausverstand beisst mensch hier auf Granit, wie ein Wasserfall bombardiert
der Richter weiterhin den Sabinus mit Daten und Uhrzeiten. Auch Einwände,
dass hier eine Verwechslung mit einer anderen Person vorliegt oder dass
sein Englisch falsch verstanden wurde, ignoriert der Richter. Als Sabinus
grundsätzlich den Sinn dieses sonderbaren Rein und Raus hinterfragt,
versucht es der Richter mit Psychologie: ob denn seine Erinnerung `normal´
sei, schliesslich vergesse man ja. Das ganze gipfelt in der vollkommen
absurden Frage, ob er sich beim Verhör im Mai 1999 besser als heute daran
erinnert habe, was im Februar geschehen sei. Auch wenn verständnisloses
Kopfschütteln als angemessene Antwort vielleicht ausgereicht hätte, stellt
Sabinus noch einmal fest, dass er genau weiss, welche Fragen ihm beim
Verhör gestellt worden sind.
Der Richter gesteht nun ein, dass im Verhörprotokoll eine handschriftliche
`Ausbesserung´ vorgenommen worden sei. Auf den Vorhalt einer `Drogenbande´
habe Sabinus zuerst ausgesagt, dass er verwirrt sei und dazu nichts sagen
könne. Nach der `Ausbesserung´ sei seine Antwort aber gewesen, dass er es
nicht wisse. Dieses Eingeständnis der Manipulation wird jedoch vom Richter
sofort gegen Sabinus gewendet: Dies sei der Beweis dafür, dass ihm alles
übersetzt worden sei, denn es gebe ja sogar `Korrekturen´ - auch wenn der
Richter nicht weiss, wer diese `Korrekturen´ vorgenommen habe und auch
nicht sagt, wann das geschehen ist. Am Gipfel dieser Logik behauptet er
noch, dass Sabinus deshalb `nicht glaubwürdig´ sei. Sabinus sagt, dass er
noch viel mehr korrigiert hätte, wenn ihm das ganze Protokoll gezeigt
worden wäre. Der Richter schliesst das ganze in despotischer Manier mit den
Worten ab: `Das ist jetzt nicht zu lösen. Er war am 26.2. dort!´. Punkt.

Verwechslungen, oder: `Das sind alles Schwarzafrikaner´

Der Anwalt weist darauf hin, dass zwar die Video-Observationen im Verfahren
nicht mehr verwendet werden - im Gegensatz zum Verfahren in erster Instanz
- dennoch streicht er auch hier Widersprüche heraus: Bei den Videos habe es
viele `Ausbesserungen´ gegeben ­ mehrmals ist Sabinus mit einer anderen
Person verwechselt worden. Und nicht nur er, wie der Anwalt feststellt: `Es
sind einige Leute wegen Ähnlichkeiten verwechselt worden´. Der Richter
bestätigt das ­ die Videos seien wegen schlechter Qualität auch nicht
(mehr) beweiskräftig: Im Lokal sei es dunkel gewesen, die Aufnahmen seien
von oben gemacht worden und ausserdem nur schwarz-weiss. Das ist noch
problematischer, denn `das sind alles Schwarzafrikaner´, weiss der
Richter. Was es aber schon gebe, sei die `augenscheinliche Betrachtung´
durch die PolizeibeamtInnen. Auch wenn es Korrekturen gegeben habe, heisse
das noch nicht, dass jemand nicht dort gewesen sei - `man kann sich irren´,
so der Richter. Und Punkt.

Plädoyers und Urteil

Abschliessend geht der Richter auf die zahlreichen Anträge, fast
ausschliesslich der Verteidigung, ein: Der Antrag auf eine Stimmanalyse sei
nicht zu erfüllen. Es gebe ein Tonband mit abgehörten Telefonaten und eines
mit abgehörten Gesprächen im Lokal `Willkommen´. Beide nicht verwertbar,
sagt der Richter: Ersteres sei vom Institut für Schallforschung
zurückgeschickt worden, mit der Begründung, dass zuviele `Nebengeräusche´
die typischen Merkmale einer Stimme nicht erkennen liessen. Auf dem zweiten
Band sei ein zu grosses `Stimmengewirr´ zu hören.
Die Gegenüberstellung mit der Zeugin sei erledigt worden. Es sei inzwischen
aktenkundig, dass sie die Freundin eines Freundes von Sabinus gewesen sei
(Anmerkung: Die Zeugin hat bisher immer geleugnet, diesen Freund überhaupt
zu kennen). Die meisten der geladenen Entlastungszeugen konnten laut
Richter `nicht ausgeforscht´ werden (so ein Zufall aber auch...). Ein Zeuge
habe sich in der vorletzten Verhandlung entschlagen, glaubt der Richter
(glauben heisst nicht wissen, denn er hat sich ganz und gar nicht
entschlagen, siehe

Ein Zeuge sei nur nach dem Vornamen bekannt; ein weiterer Zeuge sei geladen
worden, um zu beweisen, dass Sabinus die Taten nicht begangen hat ­ der
Richter meint, das sei aber nur möglich, wenn die beiden `Tag und Nacht
zusammen gewesen´ seien. Die Verteidigung habe einen Antrag abgelehnt,
einen anonymen Zeugen von der Botschaft vorzuladen, welcher behauptet habe,
Sabinus sei nicht er selbst sondern ein anderer. Die schriftliche
Überprüfung des Igbo-Dolmetschers sei obsolet, weil jetzt die `Übersetzung´
des beeideten Dolmetschers vorhanden sei.
Allen offensichtlichen Widersprüchen zum Trotz wird `der Fall´ von der
Staatsanwältin in ihrem Schlussplädoyer eiskalt abgehakt: Es sei `mit
eindeutiger Sicherheit´ festgestellt, dass er `massiv involviert´ gewesen
sei. Die Zeugin habe ihn belastet; es gebe die Telefonüberwachung und sein
Handy. Im ersten Rechtsgang habe es einen eindeutigen Schuldspruch gegeben
(welcher auch eindeutig vom OGH aufgehoben wurde); die Stimmanalyse im
zweiten Rechtsgang habe weder eine Entlastung noch eine Belastung gebracht.
Und er sei schon `einschlägig vorbestraft´ worden.

Der Anwalt weist in seinem Plädoyer zuerst darauf hin, dass dieser Tag ein
historisches Datum ist, der Internationale Tag der Menschenrechte nämlich.
Er glaubt, es ist ein guter Tag, die Verhandlung auch entsprechend
abzuschliessen.
Aufgrund des umfangreichen Prozesses fasst er zusammen: Die Beziehung der
Zeugin zu Sabinus´ Freund sei jetzt also aktenkundig ­ sie hat gesagt, dass
sie beide nicht kenne. Warum sollte sie dann gerade von Sabinus Drogen
bezogen haben? Auch die Glaubwürdigkeit der Zeugin bezweifelt er: Sie wurde
mehrmals von Polizei und Gericht verhört und hat jedes Mal etwas anderes
ausgesagt, zB hat sie sich bei ihrer Aussage über die angebliche Menge
widersprochen. Doch im Kern bleibt sie dabei, den Sabinus zu belasten.
Zum Vorhalt des `Verkaufs grosser Mengen an unbekannte Personen´ fragt der
Anwalt: `Die Hauptverhandlung dauert schon ewig. Aber wo sind die 100en
Gramm?´ Er geht auf die Operation Spring ein: Die Verfahren seien jetzt
weitgehend abgeschlossen. Es gab ein `Mords-Trara´ um diesen ersten Einsatz
von Abhörmethoden und den `grossen Schlag der Polizei´. Nur, was ist davon
übriggeblieben? Der Anwalt bemerkt, dass es zu den Grundzügen eines
rechtsstaatlichen Verfahrens gehört, dass die Unschuldsvermutung gelten
müsste, da sonst jede/r verdächtigt werden könnte. Er führt dann die
Stimmanalyse an, zu der Sabinus voll zugestimmt hat, und Sabinus sagt auch,
dass er es nicht ist. Wenn die Stimmanalyse, als letztlich objektiver
Beweis, nicht möglich sein soll, dann gelangen wir wieder zur
Unschuldsvermutung. Aber in Bezug auf die Realität dieses Verfahrens meint
der Anwalt: `Es ist halt mühsam, im einzelnen herauszuarbeiten, warum er es
nicht gewesen sein kann´ - etwa, warum er ein vorgeworfenes Telefonat nicht
geführt hat, zu einem Zeitpunkt, wo er im Gefängnis war. Dann Igbo: bei dem
es 70 Dialekte gebe ­ und die Übersetzungen sind zudem ungenau. Auch die
Feststellung einer Polizeikontrolle, die Sabinus entlastet hätte, ist nicht
durchgeführt worden. Nicht zuletzt ist der Standpunkt der
Staatsanwaltschaft im Verlauf des Verfahrens immer schwächer geworden. All
das sollte mitgedacht werden ­ auch weist der Anwalt auf das Bestreben von
Sabinus hin, seine Unschuld zu beweisen. Er sitzt schon sehr lange in
U-Haft unter miesen Bedingungen.
Sabinus wird vom Richter gefragt, ob er noch etwas sagen möchte ­ ja, das
will er: `Ich appeliere, mir zu glauben...´ (die folgende Rede in englisch
ist leider nicht mitgeschrieben worden, sorry!). Als die Dolmetscherin
beginnnt, seine Rede zu übersetzen, wird sie in üblicher Manier vom Richter
abrupt unterbrochen. Beratungspause ­ Punkt.
Nach seiner Rückkehr verkündet der Richter, dass Sabinus `schuldig´ sei und
zu einer Haftstrafe von viereinhalb Jahren verurteilt werde. Denn er sei
ein Suchtgifthändler, hauptsächlich aufgrund von Aussagen der Zeugin. Er
sei `Mitglied einer Organisation´ gewesen. Die Länge der Haft sei ein
Milderungsgrund, während seine Vorstrafen `im gleichen Milieu´ erschwerend
seien. Und Punkt.

CRIMES AGAINST THE WOMEN OF COLOMBIA
ARE CRIMES AGAINST HUMANITY

“Neither a sexual object nor a military objective”(l)

December 2002

Rape and torture of women has become a recurrent practice of the actors in
the armed conflict, especially in the city. The national coalition of Women
Against War expresses its indignation and wishes to expose the crimes
against humanity that the various armed actors have been committing against
women amidst the armed conflict in Colombia, and we especially denounce the
systematic sexual violation of women in various areas of the city of Medellin.

During the week of 25 November, the day on which the international day of
non-violence against women was commemorated, a young woman, well known as a
defender of the human rights of women and a member of an organization of
women who work for peace and for a negotiated solution to the armed
conflict, was sexually abused by several members of the Autodefensas Unidas
de Colombia (United Self-defense Groups of Colombia), who, not satisfied
with rape and torture, branded her with the three letters standing for the
name of their organization, AUC. This young woman was systematically
tortured for over an hour, with cuts to her legs, breasts and lips, and
cigarette burns to various parts of her body. After these atrocious acts,
this group threatened to kill her and her family if she were to denounce
the incident, demanding that she stay in her house and neither move about
the neighborhood nor speak with anyone.

This outrage has deeply disturbed the women’s movement in this country,
which, given the circumstances, will denounce the crimes against humanity
that are being committed against women in Medellin and over the entire
country and which already have been denounced by the Office of the High
Commissioner on Human Rights of the United Nations.

The women of Colombia seek the solidarity of the society, of the women’s
movement and of the social and political movements, both national and
international, because we cannot remain silent before the impunity and the
concealment of these crimes against humanity that continue proliferating
daily in Colombia.

The Vienna World Conference on Human Rights (1993) and various other
conferences, conventions and declarations of the United Nations have
emphasized that the human rights of women are integral to human rights in
general and refer to violence against women as a serious human rights
violation. Likewise, the Geneva Conventions, international norms that
regulate armed conflicts, affirm that “Women will be especially protected…
against rape, forced prostitution and any assault against their chastity or
modesty.” Rape is a crime against humanity, an act of torture, and is
clearly prohibited by the norms governing hostilities and international
norms of human rights.

According to the most recent U.N. report on violence against women (for the
period 1997-2000) presented by the Special Rapporteur Radhika Coomaraswamy
(2) published on 23 January 2001, there is a gap between recognition on the
part of the international community and the political will of member States
to apply and enforce international humanitarian law and the norms of human
rights. (3)

Rape is not an accident of war and it is as serious a crime as torture and
slavery. Rape of women is a crime against humanity, be it in time of war or
in time of peace. In time of war, rape is on the increase, as it is being
used as a weapon. The bodies of women have been turned into spoils of war
for all the armed actors, in many cases simply with the goal of
humiliation. According to international norms, among crimes against women
can be listed: sexual slavery and forced prostitution, forced pregnancy,
forced sterilization and other sexual violence of comparable seriousness.

Unfortunately, corruption among the various armed actors has led to a
scandalous increase in the number of rapes of women, along with other types
of violence. These crimes remain unseen in the midst of daily confrontation
among the various armed actors, resulting in deaths, displacements and
other damaging effects in the lives of the civilian population.

In 1998, we denounced the violations committed by various soldiers against
the indigenous women in the zone of Uraba. This case was documented and put
in the hands of the appropriate authorities. When a soldier rapes a woman,
that violation is not a private act of violence but an act of torture and
one of the crimes for which the State has responsibility. When the
government in our country has neither investigated nor punished this type
of violence committed by its own armed forces, precedents are set that lead
to impunity and that promote rape as a weapon of war to be used by all the
armed actors.

According to estimates by the responsible agencies, in Colombia, only 10%
of rapes are denounced, because women are ashamed and afraid to make public
what has happened to them. Some erase the experience from their memory
because recalling the trauma causes them unbearable pain. The price that
women pay goes from psychological wounds that last a lifetime to serious
physical lesions, pregnancy, sickness and even death.

In addition to the fear that rape victims feel because of possible
retaliation on the part of the aggressors should they be denounced, the
women feel a growing lack of confidence in the State agencies with regard
to making a denouncement, as the women of the neighborhoods know about the
complicity, through action or inaction, of the police with paramilitaries
and/or the gangs that have been co-opted by those armed groups.

According to information from people at the Instituto de Medicina Legal
(Institute of Forensic Medicine) in Medellin, at least four women are
murdered in the city daily, two of whom have also been raped. There are 16
rapes daily, only four denouncements and only one is ever brought to trial.
(4) During the first ten months of 2002, 656 rapes had been denounced.
This can only be an estimate, as only a small percentage of women who are
raped dare to denounce this crime.

In Medellin, the most affected by this crime are the women and girls who
live in the disputed territories, for in the midst of the paranoia
generated by the war, they are easily accused of having emotional or family
ties with one or another of the armed actors. Furthermore, it is noted that
the women’s organizations are seen as a threat by these armed actors, when,
in reality, the women are simply working to strengthen the civil society
and the community fabric. These women and their organizations are being
accused of acting as a cover for the guerrillas or of being friendly with
any other of the various armed actors.

An example of the above is what happened surrounding the arrest and
persecution of four women of the community organization Asociacion de
Mujeres de las Independencias (Association of Women of the
Independencias AMI), located in Commune 13 of Medellin, an organization
that has dared to denounce the crimes committed by the various armed
groups, disappearances in the zone, as well as the excesses committed by
the public informants in operation “Orion”. In this case, the women [who
had been wrongly arrested] were set free, but the case is not closed and
subsequently their houses have been broken into and they have been the
victims of repeated harassment. During 2002 in Commune 13 alone,
approximately 500 families have been displaced.

This shows us how living in a war zone, without any intervention by the
State government and with the illegal armed actors in power, the women and
their pacifist organizations have been singled out and arrested by the
security agencies of the State.

In addition to all this, the armed actors enslave the women in the rural
areas and in the cities as well, threatening them and forcing the women to
provide various services for them, such as cooking, washing their clothes,
transporting arms, sewing for them, etc. This has occurred with the
militias and continues in Commune 13 of Medellin on the part of
paramilitary groups that have captured the zone as the legal forces of the
State have withdrawn.

Also, in many sectors of the city that are under the control of one armed
actor or another, curfews are imposed under the threat of killing any men
who do not observe the prohibitions and, in the case of a woman who is in
the street after the indicated hour, she is raped. These measures have
caused some women, both young women and older ones who take night courses,
to have to abandon their studies because they are not free to move about
after certain hours at night.

We have also been able to verify that displaced women are the most exposed
to sexual violation and aggression, as well as being led into forced
prostitution owing to their vulnerability and lack of social, economic and
psychological protection.

Likewise, in various areas of the country, sex workers are becoming targets
in the conflict, as they are used by various armed actors who subsequently
murder them, an example of this being the Department of Arauca where this
type of crime occurs daily.

We call on the media and the appropriate authorities to handle these cases
in a serious and responsible manner, because, otherwise, the bodies and
lives of these women are at risk.

We want the various armed actors to be aware that when they rape, enslave
or subjugate women to forced labor, it is as if they are committing these
crimes against their mothers, daughters, girlfriends, wives or partners
and, at the same time, they are encouraging more of this type of crime.
These crimes are very serious infractions of International Humanitarian
Law, which affords special protection to women and children in time of war.

We reiterate that the security and life of the women of the social and
community organizations, which are in serious danger at this time, is the
responsibility of the State, and we request protective action, so that all
the armed actors will clearly understand that these crimes against women
are crimes against humanity. We demand that the State investigate and
impose penalties on those who are responsible and request that compensation
be made to the victims of these crimes in order to being about an end to
such atrocities.

We women are not spoils of war. We demand truth, justice and reparations!

denouncements of rape and sexual abuse in Colombia, perpetrated especially
by the paramilitary groups connected to the armed forces of Colombia. For
example, on 18 February, some 300 armed men, members of the Autodefensas
Campesinas de Cordoba y Uraba (Rural Self-defense Groups-ACCU) established
an illegal tribunal in the village of El Salado, Bolivar. During the
ensuing two days, they tortured, beat, stabbed, decapitated and killed a
group of residents. Some witnesses told the investigators that they tied a

that Andis Villalobos was forced to cook for the paramilitaries, was
mistreated and was threatened with sexual abuse. It has also been reported
that during the armed conflict, the guerillas committed an assortment of
abuses. In Barrancabermeja guerilla forces and groups attached to them have
been responsible for many deliberate and arbitrary executions of
individuals they thought were among the military and paramilitary
collaborators or sympathizers, including young people thought to be
associated with members of the security forces.

“How to reconcile the
annihilation of death with
the irrepressible zeal for life?”

The women of the Organizacion Femenina Popular (OFP), true to our
principles of acting autonomously as citizens, have maintained a vigorous
presence, a firm voice, rising above the silence imposed by the clash of
weapons, a din that has become ever more deafening towards the end of
November when those in power began attacking one another.
Meanwhile, recalling other times not so long ago, the civilian population
were asking themselves what had become of peace in Barrancabermeja, and
they are convinced that peace does not emanate from the use of weapons. But
they are also convinced that the civilian, military and police officials
are not aiming towards democracy within the framework of a legal Social
State, rather, government by force of arms, be they weapons wielded by the
State or by the illegal armed actors.

In this setting, and with the “assistance” of the Network of Informants,
the authorities in Barrancabermeja have taken on the task of breaking into
the houses of families in various sectors of the city, carrying out the
proposal for Democratic Security of the current President of the Republic,
Dr. Alvaro Uribe Velez. As one might suppose, much of the “information”
comes from unreliable sources, who sell supposed intelligence to enrich
themselves with a few pesos in order to stay afloat in these difficult
socio-economic times and, perhaps, in the hopes of a “stroke of luck”
(coincidence).

Such is the case of the family of our colleague Mildred Lucia Plata, a
nurse for the OFP. At 4:00 a.m. on 9 December, 4 heavily armed men, some
in uniform and some dressed as civilians, arrived in a 4-door station wagon
and broke into her residence in Barrio Palmira, because an informant had
stated that “they are paramilitaries in that house and they are hiding
weapons.”

This family suffered one of the many “mistakes” of the public informants,
who, after being denounced by those affected, asked the family to “leave it
alone; since we didn’t find anything, you have nothing to worry about.”
This sort of break-in has happened to other families in the city, in Barrio
Palmira and Barrio Parnaso and Primero de Mayo, as well.

In light of the anxiety generated by such actions and the worry and concern
of the families, as well as the need to re-establish state authority in
such a way that it will truly fulfill its function to “preserve the life
and honor of all citizens”, the OFP feels the urgency to raise our voices,
once again, and to demand:

-That the civilian, military and police official carry out their
responsibilities and sanction the delinquents, not innocent civilians.

-That they investigate and make clear details about the unwarranted
break-ins that are occurring in Barrancabermeja and which are damaging to
the person, the good name and the honor of citizens like the Rueda Plata
family. Which officials are doing this, with what authority, with what
interest or pretext?

-That restitution for damages be given to the families.

-That the policy for the security of citizens implemented by the government
of the current President of the Republic be reviewed as soon as possible,
so that the political climate of the city, our region, and the country does
not become ever more rarefied.

While in the city the paramilitaries control social, economic and political
life, the authorities “are mistaken” in pursuing and attacking the
integrity of defenseless families.

“We women do not give birth, nor do we raise sons and daughters for war”

While it now appears likely that Rudolph Holton will not be released in
time for Christmas, I believe it is equally likely that he will be out
soon, so at least he has that hope in this holiday season. See TODAY's
Tampa Tribune article below.

Death Row Christmas Miracle Unlikely

TALLAHASSEE - Like his fellow death row inmates, Rudolph Holton probably
won't be home for the holidays - at least not this year.

A campaign by death penalty opponents to have the 49-year-old Tampa man
released before Christmas probably will fail. The state attorney general's
office has not had time to review an order the Florida Supreme Court issued
last week agreeing with a lower court that Holton deserves another trial.

Holton has been on death row for 16 years for the murder and rape of
17-year-old Katrina Graddy. Last year, as prosecution witnesses started
recanting and DNA testing cast doubt on forensic evidence used to convict
Holton, Hillsborough Circuit Judge Daniel Perry ordered a new trial.

On Friday, members of Floridians for Alternatives to the Death Penalty
started calling Hillsborough State Attorney Mark Ober's office, asking that
Holton be let go before Christmas.

``There is no evidence to retry him on,'' said Abe Bonowitz, a spokesman
for the antideath penalty group. ``What they need to do is simply admit
that and let him go. We think he should be home in time for Christmas.''

But Assistant State Attorney Pam Bondi said the Florida Attorney General's
office must first decide whether to ask the Supreme Court for a rehearing.
If there is no appeal for a rehearing, then Ober's office will decide
whether to retry Holton. Bondi said prosecutors are reviewing the case to
see if there is enough evidence for a retrial.

``I had it at home with me last night,'' Bondi said. ``We're reviewing it
over the holidays.''

Carolyn Snurkowski, an assistant attorney general, said she didn't see the
Supreme Court order until Friday. She said her staff probably will review
the order Thursday.

``The order was not very detailed, so there's not a lot to work with,'' she
said.

Martin McClain, Holton's attorney during his quest for a new trial, said
all the original evidence used to convict his client has ``evaporated.''
Hair found in Graddy's mouth, hair prosecutors tried to link to Holton,
later was shown through DNA testing to belong most likely to Graddy.

And several witnesses admitted lying about seeing Holton with Graddy the
night she died. A key state witness, a jailhouse informant who said Holton
confessed, also recanted.

``Obviously it would be a nice Christmas present for Mr. Holton'' to be
released, McClain said. Prosecutors ``may want to take some time to
evaluate their case. I understand that, but Mr. Holton's been there 16
years for a crime he didn't commit, so I want him out as soon as possible.''
